TERMS & CONDITIONS

ABOUT THESE TERMS

These terms apply to all quotes, products and services supplied by INKFUSE (“InkFuse”, “we”, “us” or “our”).

By accepting a quote, approving artwork, making payment or instructing us to begin work, you agree to these terms.

QUOTES AND ORDERS

Quotes are based on the information, quantities, garments and artwork supplied at the time. Unless stated otherwise, quotes are valid for 30 days.

Changes to quantities, garments, artwork, decoration size, placement or delivery requirements may change the price or turnaround time. We will obtain your approval before adding any extra charge.

All prices are in New Zealand dollars. GST will be shown on the quote or invoice.

An order is confirmed once we have received the required approval and any payment or deposit stated in the quote.

PAYMENT

Payment must be made according to the terms shown on the quote or invoice.

We may wait for payment, artwork approval or garment availability before starting production. Completed orders may be held until all amounts due have been paid.

ARTWORK AND APPROVAL

You are responsible for checking all spelling, numbers, dates, colours, sizing, placement and other details shown in an artwork proof.

Once artwork is approved, InkFuse is not responsible for errors that were visible in the approved proof. We remain responsible for producing the order in accordance with the approved artwork and using reasonable care and skill.

Embroidery and DTF printing may require small technical adjustments to make artwork suitable for production. Any significant change will be shown to you for approval.

Colours displayed on screens may differ from printed, embroidered or physical colours. Thread, garment fabric, lighting and production methods can also cause reasonable colour variation.

CUSTOMER ARTWORK AND INTELLECTUAL PROPERTY

You confirm that you own, or have permission to use, all logos, artwork, wording, photographs and other material supplied to us.

You are responsible for any claim resulting from material supplied without the owner’s permission. We may refuse work that we reasonably believe is unlawful, offensive or infringes another person’s rights.

You retain ownership of artwork supplied by you. Unless agreed otherwise in writing, embroidery files, digitising files, print separations and other production files created or commissioned by InkFuse remain our production files.

GARMENTS AND MATERIALS

Garment colours, sizing and availability depend on the blank-garment supplier. Size charts are a guide, and you are responsible for selecting the required sizes.

We will not substitute a garment, colour or material without your approval.

Customer-supplied garments will be handled with reasonable care. However, we cannot guarantee how unknown fabrics, coatings, previous damage or manufacturing defects will react during printing, pressing or embroidery. This does not remove our responsibility where damage is caused by our failure to use reasonable care and skill.

TURNAROUND TIMES

Turnaround times are estimates and normally begin once artwork is approved, required payment is received and garments or materials are available.

Embroidery digitising normally takes 2–3 working days after suitable artwork is received. Complex designs or requested revisions may take longer. The embroidery production turnaround begins after the final artwork and embroidery file are approved.

If you have a fixed deadline, it must be confirmed by us in writing before the order is accepted. Supplier shortages, courier delays or events outside our reasonable control may affect completion dates.

Rush charges or other additional costs will never be added without your approval.

CHANGES AND CANCELLATIONS

Because decorated garments are made specifically for you, change-of-mind cancellations may not be accepted once artwork, digitising, garment ordering or production has started.

If you cancel before completion, you may be charged only for reasonable costs already incurred, including approved artwork, digitising, ordered garments and completed production work. Any remaining balance will be refunded.

Nothing in this section removes any rights you have under New Zealand law when products or services are faulty, misdescribed or not completed with reasonable care and skill.

DELIVERY AND COLLECTION

You are responsible for providing a complete and accurate delivery address.

Where we arrange delivery, please contact us promptly if an order is damaged, delayed or missing so we can investigate with the courier and provide any remedy required by law.

Orders collected from InkFuse should be checked as soon as reasonably possible.

QUALITY ISSUES AND CARE

If there is a problem with your order, contact us promptly at orders@inkfuse.co.nz and include photographs and details of the issue.

Please do not wear, wash or distribute affected items before giving us a reasonable opportunity to inspect them.

Garments must be washed and cared for according to the garment and decoration instructions supplied. Damage caused by incorrect washing, ironing, drying, bleaching or other misuse is not considered a production fault.

Where an order does not meet an applicable legal guarantee, we will provide the appropriate repair, replacement, reprint, refund or other remedy required by New Zealand law.

NEW ZEALAND CONSUMER LAW

Nothing in these terms excludes or limits any right or remedy that cannot legally be excluded under the Consumer Guarantees Act 1993, Fair Trading Act 1986 or other New Zealand law.

Where you acquire products or services from us in trade for business purposes, and it is fair and reasonable to do so, both parties agree in writing that the Consumer Guarantees Act 1993 will not apply to that business transaction.

PERSONAL INFORMATION

We collect information including your name, business name, email address, phone number, delivery details, job requirements and uploaded artwork so we can respond to enquiries, prepare quotes, produce orders, arrange delivery, keep business records and meet our legal obligations.

We may share information with service providers such as garment suppliers, production partners, couriers, website providers, email providers and accounting services where reasonably necessary to complete your order or operate our business.

We do not sell personal information. We take reasonable steps to keep it secure and use it only for the purpose for which it was collected or another purpose permitted by law.

EVENTS OUTSIDE OUR CONTROL

We are not responsible for delays caused by events outside our reasonable control. We will notify you where practical and take reasonable steps to reduce the effect on your order.

CHANGES TO THESE TERMS

We may update these terms from time to time. The terms applying to an order will be the version accepted when that order was confirmed.

GOVERNING LAW AND CONTACT

These terms are governed by New Zealand law.
